Public Consultation on a Proposal to Amend Section 11A of the Weights and
Measures Act 1985 relating to testing, passing and stamping of weighing and
measuring equipment as fit for use for trade by means of a Regulatory Reform
Order.
Section 11 of the Weights and Measures Act 1985 requires certain classes of
weighing and measuring equipment (e.g. shop scales, petrol pumps, beer meters,
some industrial equipment) to be tested, passed and stamped (verified) as fit
for use for trade before being placed or returned into such use.
Approved verifiers are manufacturers, installers or repairers granted an
approval by the Secretary of State to carry out verification of certain
equipment. They are currently permitted to carry out verification following the
activity of manufacture, installation or repair.
This proposal intends to permit approved verifiers to conduct the verification
of equipment after carrying out adjustment of weighing or
measuring equipment, as part of maintenance work, that subsequently requires
the weighing and measuring equipment to be verified before it can be returned
into use for trade.
The proposal will affect:

Businesses that use weighing and measuring equipment that, following
adjustment, requires verification before it can be placed back into use for
trade
-
Consumers who buy products weighed or measured on the equipment referred to
above.

Businesses carrying out manufacturing, installing or repairing of weighing and
measuring equipment which undertake the adjustment of such legally compliant
equipment that subsequently requires verification following adjustment under
section 11 of the Act.

Local authorities whose inspectors of weights and measures currently have sole
responsibility for carrying out such verification following adjustment of
equipment referred to above.
